This End User License Agreement governs installation and use of the Rolelanded AI system and related software components installed on your local system.
This End User License Agreement (“EULA”) is a legally binding agreement between the user (“User”) and Evolving Mind AI Technologies Private Limited, a private limited company incorporated under the Companies Act, 2013 (India), with its registered office in Telangana, India (“Company”), governing installation and use of the Rolelanded AI system and related software components installed on the User’s local system. The terms that are not expressly defined herein shall have the meaning prescribed to them in the Terms of Service.
This EULA shall be read together with the Terms of Service, Privacy Policy, applicable Data Processing Agreement, and the AUP, all of which are incorporated herein by reference. In the event of any conflict between this EULA and the Terms of Service with respect to terms related to software licensing and installation of the AI system on local devices, this EULA shall prevail. For all other matters, the Terms of Service shall prevail.
The Company grants the User a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use the Rolelanded AI system on the User’s personal device solely for interview advisory and preparatory purposes. The software is licensed, not sold. No ownership rights are transferred to the User under this EULA. The license is strictly limited to lawful personal use in accordance with the Terms of Service, Acceptable Use Policy, and applicable law.
The AI system may be installed and executed on the User’s local system. The User acknowledges that local installation does not transfer any proprietary rights in the software, architecture, models, algorithms, prompts, or configuration systems. All intellectual property rights remain exclusively with the Company or its licensors. The User shall not distribute, resell, lease, rent, sublicense, or otherwise commercially exploit the software.
The license is conditional upon compliance with age eligibility requirements. The software is available only to individuals aged eighteen years or older. Installation or use by minors is strictly prohibited, including with parental consent. The User represents that they meet eligibility requirements at the time of installation and throughout the duration of use.
The Company reserves the right to modify, update, suspend, or discontinue the licensed software at its discretion. Continued access may require authentication, Credit purchase, or technical validation mechanisms implemented by the Company. Violation of this EULA automatically terminates the license without further notice.
The AI system provides automated, AI-driven interview advisory and preparatory services. It does not evaluate, score, rank, certify, endorse, or assess employability. The software does not provide recruitment, placement, or hiring services. It is not a job marketplace and does not connect Users with employers.
The software operates without human reviewers or evaluators. All outputs are generated automatically by artificial intelligence systems. The Company does not manually verify or edit AI-generated responses prior to delivery. The User acknowledges that outputs are advisory and informational only.
The Company makes no guarantee of interview outcomes, job offers, hiring decisions, or employment results. Success in interviews depends on numerous external variables beyond the Company’s control. The User assumes full responsibility for how they interpret and use AI-generated guidance.
The software may generate outputs based on User inputs, including resumes, job descriptions, client names, and optional contextual data. Outputs may not be unique. Similar responses may be generated for other users. The Company does not guarantee originality or exclusivity of outputs.
The AI system may be installed and executed on the User’s local system. The User is solely responsible for the security, compatibility, configuration, maintenance, and lawful operation of their device, operating system, hardware, storage, and network environment. The Company does not control or monitor the User’s device environment.
The Company does not warrant compatibility with all operating systems, enterprise firewalls, antivirus programs, hardware configurations, or IT policies. The User assumes all risks associated with installation, execution, updates, and device-level integration. Device conflicts, corruption, or malfunctions are outside the Company’s responsibility.
The Company is not liable for malware infections, data corruption, unauthorized access, hacking, system instability, hardware damage, or data loss occurring on the User’s device. The User must maintain appropriate cybersecurity safeguards on their own systems.
The Company may require authentication or connectivity to cloud infrastructure for certain features, including credit validation, analytics, and storage synchronization. The User acknowledges that offline or restricted environments may limit functionality.
Use of the AI system requires account registration. Users must provide accurate name, email address, resume, client name, job description, and role name. Email verification is mandatory. Disposable or anonymous email addresses are prohibited.
Users may not create multiple accounts. Account sharing is prohibited. Each installation must correspond to a valid registered account. The User is responsible for safeguarding login credentials and preventing unauthorized access.
Enterprise Users may be onboarded separately and may manage multiple candidate accounts. Enterprise oversight does not convert the software into an evaluative or recruitment tool. Enterprise Users remain responsible for compliance by associated accounts.
The Company may suspend or terminate access without notice for misuse, false information, account sharing, or violation of policies. Suspension may deactivate software functionality even if installed locally.
The software processes User data including resumes, prompts, voice recordings for transcription, job descriptions, and related inputs. Certain data may be processed locally prior to synchronization with Company infrastructure. The Company’s data protection obligations apply to data processed within its controlled infrastructure and through third-party service providers engaged by the Company under contractual obligations.
Stored data may include voice recordings (audio), transcripts, interview questions, AI Outputs, chat logs, and screen captures for future User reference. The Company does not use advertising cookies or cross-site tracking technologies for advertising profiling or behavioral advertising. The Platform and its service providers may process limited device, network, and usage data (which may include IP address, device/app identifiers, app version, and event/log data) for authentication, security, fraud prevention, reliability, analytics, and crash/error reporting. The Company does not sell such data or use it for cross-context behavioral advertising.
User data is used strictly for Service delivery, analytics, product improvement, and Platform security. It is not used by the Company for AI model training or benchmarking. User data may be processed by third-party AI service providers solely to generate AI Outputs for the Services. Data is not sold or monetized.
Upon account deletion, all User data stored within Company-controlled systems is deleted or irreversibly de-identified. Deleted data may remain in encrypted backups for a limited period and may be overwritten or deleted on a rolling basis, subject to applicable law.
All rights in the AI system software, system architecture, algorithms, code, prompts, interfaces, trademarks, branding, and proprietary technologies remain exclusively with the Company or its licensors. The User receives only a limited license to use the software.
User prompts constitute user-generated content. AI Outputs are generated through third-party AI systems and displayed without ownership claims by the Company. The Company does not assert proprietary ownership over substantive AI Outputs.
Users shall not reverse engineer, decompile, extract model parameters, modify configuration files, or create derivative works from the software. Local installation does not authorize technical analysis beyond normal use.
Feedback provided by Users may be used by the Company without restriction. The Company retains the right to incorporate suggestions into future product development without compensation.
The User shall not use the software for unlawful, fraudulent, or harmful purposes. Uploading confidential employer materials, proprietary interview frameworks, or third-party trade secrets without authorization is prohibited.
The User shall not attempt to bypass credit systems, exploit free trial limitations, manipulate payment mechanisms, or initiate fraudulent chargebacks. Credits are prepaid, non-refundable, and non-transferable.
The software may not be used to develop competing products, conduct benchmarking, or extract system behavior for commercial gain. Automated scraping, bot usage, and adversarial testing are prohibited.
Violation of these restrictions constitutes material breach and may result in termination, forfeiture of credits, and legal action.
Access to features beyond the free five-minute trial requires purchase of credits. Payments are non-recurring. Credits are prepaid and have no independent monetary value outside the Platform.
Regional pricing may apply. Currency conversion is handled through payment processors. Taxes may be applied where required by law. All fees are non-refundable except where mandated by law.
Payment processing is handled through third-party processors. The Company does not store full payment card information. The Company disclaims liability for payment processor failures.
Fraudulent chargebacks or payment disputes may result in suspension pending investigation. Abusive chargebacks may result in permanent termination.
The AI system and all related software components are provided on an “as is,” “as available,” and “with all faults” basis. The Company expressly disclaims all representations and warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, completeness, reliability, non-infringement, quiet enjoyment, or uninterrupted availability. The User acknowledges that artificial intelligence systems are probabilistic and may produce inaccurate, incomplete, outdated, or misleading outputs.
The AI system provides advisory and preparatory guidance only. It does not provide professional, legal, employment, recruitment, placement, psychological, or career counseling services. The Company does not evaluate employability, assess candidacy, or guarantee interview performance. All reliance on AI-generated outputs is at the User’s sole discretion and risk.
The Company does not warrant that the software will operate without interruption, error, delay, incompatibility, security vulnerability, or technical defect. The Company makes no warranty regarding compatibility with specific devices, operating systems, enterprise environments, firewalls, or security software. Installation and execution on the User’s local system occur at the User’s sole risk.
The Company does not warrant that AI Outputs will be unique, original, or exclusive to the User. Similar or identical outputs may be generated for other users. The Company does not guarantee the absence of bias, error, or contextual misinterpretation despite implemented mitigation measures.
To the fullest extent permitted by applicable law, the Company disclaims liability for any decision, action, or inaction taken by the User based on AI-generated outputs, including interview responses, communication strategies, or employment-related conduct. The User assumes full responsibility for verifying accuracy and appropriateness before use.
To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, or any loss of employment opportunity, loss of income, reputational harm, data loss, device damage, business interruption, or emotional distress, arising out of or related to installation or use of the software.
The Company shall not be liable for damages arising from locally installed components, including system conflicts, malware, unauthorized access, hardware malfunction, operating system incompatibility, or third-party software interference. The User assumes full liability and responsibility for device-level risks.
The Company shall not be liable for inaccuracies, omissions, hallucinations, or contextual errors generated by the AI system. The User acknowledges that AI systems are inherently limited and that outputs are advisory only. No liability shall arise from reliance on such outputs.
In all circumstances, the Company’s total cumulative liability for any and all claims shall not exceed the total amount actually paid by the User for credits during the three (3) months immediately preceding the event first giving rise to the claim. If no payment has been made, the Company’s total cumulative liability for any and all claims shall be limited to a commercially reasonable nominal sum determined by it at its sole discretion.
These limitations apply regardless of the theory of liability, whether in contract, tort, negligence, strict liability, statutory claim, or otherwise, and shall survive suspension, termination, or deletion of the User’s account.
The User agrees to indemnify, defend, and hold harmless the Company, its directors, officers, employees, affiliates, licensors, processors, and agents from and against any and all claims, liabilities, damages, losses, costs, fines, penalties, and expenses, including reasonable attorneys’ fees, arising out of or related to the User’s content, misuse of the software, or violation of this EULA.
The User shall indemnify the Company for claims arising from unauthorized disclosure of employer confidential information, proprietary interview materials, trade secrets, or third-party confidential data submitted through the software. The Company bears no responsibility for User-uploaded confidential content.
The User shall indemnify the Company against claims resulting from violations of applicable law, including data protection laws, intellectual property laws, recording consent laws, employment regulations, or contractual confidentiality obligations. Compliance with all laws remains the User’s sole responsibility.
The indemnification obligation extends to claims arising from local installation risks, including device compromise, unauthorized access, or misuse of outputs by third parties with access to the User’s system. The Company bears no liability or responsibility for the User’s device environment.
This indemnification obligation survives suspension, termination, deletion of account, or discontinuation of Services and remains enforceable to the fullest extent permitted by law.
This EULA shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. The User expressly agrees that the governing law applies irrespective of the User’s country of residence or installation location.
The competent courts located in Hyderabad, Telangana, India shall have exclusive jurisdiction over any dispute arising out of or relating to this EULA, subject to any arbitration mechanism the Company may elect to invoke. The User irrevocably submits to such jurisdiction.
The Company reserves the right to require binding arbitration for disputes at its discretion. Any arbitration shall be conducted in accordance with the Arbitration and Conciliation Act, 1996 (as amended from time to time), and the seat and venue of arbitration shall be in Hyderabad, Telangana, India.
The User waives any objection to jurisdiction, venue, or forum non conveniens. The User further waives the right to participate in class actions, collective proceedings, or representative claims against the Company.
Nothing in this section limits the Company’s right to seek injunctive or equitable relief in any jurisdiction to protect intellectual property, confidential information, or enforce usage restrictions.
The Company may suspend or terminate the license granted under this EULA at any time, with or without notice, for any reason including violation of policies, misuse, fraud, or legal compliance requirements. Termination may disable locally installed functionality remotely.
Upon termination, all rights granted to the User immediately cease. The User must uninstall and permanently delete all locally installed software components and cease all use of the AI system.
The User may terminate this EULA by discontinuing use, uninstalling the software, and requesting account deletion. Fees paid are non-refundable. Credits remaining at termination are forfeited unless otherwise required by law.
Termination does not relieve the User of outstanding payment obligations, indemnification duties, confidentiality obligations, or liability limitations. These provisions survive termination indefinitely.
The Company may discontinue or modify the software at its discretion. The Company bears no liability for permanent discontinuation, feature removal, or architectural changes, including changes to local installation models.
